Internationalization of the law

Theme : «The Chinese and western representations of the law - Their evolution in front of the globalization - The question of the access to the law»

 

The globalization drives very strong interdependences between countries, and the necessity increases to admit the law to a complex, interactive thought.

In China, the debats becomes intensified on the notion of « universal values  » (普世价值 pushi jiazhi). Do such values exist? Should not we rather speak about « universalisable values », by wondering what are the representations of the law and how they are transformed by the globalization? We can also be interested in the notion of « world public good », which allows to organize the dynamics of the market and the ethics of the values, and in the problem of the access to the law.

  • State subject to the rule of law evolves all over the world : under what new constraints and according to what lines of force is this evolution made?
  • China and France have a common base: the right paper. How to guarantee the access to the law for all the citizens, in particular in countrysides (digital divide)? How to insure the distribution (translation, "légistique")?
  • How asks the question of the necessary link (or not?) between rule of law and economic development? Is there a business law? What would be the limits and the skills?
  • How to answer the need of justice which is smelt and whose clogging of the courts in numerous countries shows the growing strength?
  • How to reconcile the superiority of an international criminal justice and the traditional principle of non-intervention?

The Roundtable will be held in september in Paris, in the presence of Mrs Mireille Delmas-Marty, professor in the Collège de France, in partnership with the French Documentation, the Commercial court of Paris and ESCP Europe.
